The Problem: This is the highest road in Kentucky. It is narrow, steep, and full of switchbacks designed for tourists, not 18-wheelers.
The "Center Line" Violation: A loaded coal truck cannot stay in its lane on these hairpin turns. They swing wide, forcing oncoming cars into the guardrail or off the mountain.
Brake Fade: Descending Black Mountain with 60 tons of coal requires perfect brakes. If the maintenance was skipped, those brakes fail, turning the truck into a runaway missile.
The Legal Weight Limit: 120,000 lbs vs. Reality
Kentucky allows coal trucks to be heavier than normal trucks (up to 120,000 lbs) only on the Extended Weight Coal Haul Road System.
The Violation: Many trucks leave these designated routes to take shortcuts through hollows (like KY-38 in Evarts or KY-2008).
The Strategy: If we catch a 120,000-lb truck on a road rated for 44,000 lbs, the company is negligent per se. They were breaking the law the moment they turned onto that road. We use GPS data and scale tickets to prove they were where they shouldn't have been.
"Squeeze" Accidents in the Hollers
In communities like Closplint or Cranks, the roads are barely two lanes wide.
The Setup: You meet a coal truck in a curve. The rock wall is on your right; the truck is on your left.
