• The Reality: Many boaters believe the "open water" makes it safe to drink and drive. It doesn't. Sun, wind, and vibration accelerate impairment ("Boater's Fatigue").

• Our Strategy: We subpoena the receipts from the marina store or local liquor stores to prove exactly how much alcohol was purchased before the boat left the dock.

Rental Boat Negligence (The Tourist Trap)

Many accidents on Lake Cumberland involve inexperienced tourists renting massive double-decker pontoons.

• Negligent Entrustment: Did the marina rent a 30-foot boat to someone who clearly didn't know how to operate it?

Jet Ski & PWC Accidents

• Wake Jumping: Jumping the wake of a large cruiser is illegal if done too close. If a boat driver swerves to hit a jet skier intentionally, that is assault.

Propeller Strikes: The Silent Killer

• "Circle of Death": When a boat operator is thrown overboard without a "kill switch" lanyard attached, the boat will naturally steer into a tight circle, repeatedly running over the driver and passengers in the water.

Jurisdiction: Who Investigates?

Knowing which agency handled the report is critical:

• KDFWR (Fish & Wildlife): The primary investigators for boating accidents in Kentucky. Their reports are detailed and specialized.

• County Sheriff: (Pulaski, Laurel, Russell, Wayne) often respond to dock fights or drownings.

• US Coast Guard: Rarely involved on our inland lakes unless it is a commercial vessel issue.
